Terms of Service

Last updated: 5 October 2026

1. About these terms

These terms govern your organisation's use of Waiver (the "Service"), an online tool for recording and managing UK Health & Safety information. By creating an account or using the Service you agree to them on behalf of your organisation, and confirm you have authority to do so.

2. The Service

Waiver is a record-keeping and workflow tool. It is not professional Health & Safety, legal or medical advice, and it does not decide for you whether an incident must be reported to the HSE or whether any legal requirement has been met. Those decisions, and compliance with your legal duties, remain with your organisation.

We may improve, change or withdraw features from time to time. We will give reasonable notice of any change that materially reduces the Service you are paying for.

3. Accounts and organisation approval

You must provide accurate registration details and keep your login credentials secure. You are responsible for all activity under your organisation's accounts, including users you invite.

We may ask for company registration documents to verify your organisation, and may restrict or suspend an organisation we cannot verify.

Organisation Owners and Admins can invite, deactivate and remove users. You must deactivate users who should no longer have access.

4. Plans, pricing and payment

You can start using Waiver for free. The paid subscription costs $9 per user per month. A "user" is an active member of your organisation; deactivated members are not charged.

Subscriptions are billed monthly in advance through our payment provider, Stripe, and renew automatically until cancelled. You can cancel at any time from the billing portal; cancellation takes effect at the end of the current billing period and we do not give partial refunds unless required by law.

Prices exclude any applicable taxes. We may change prices on at least 30 days' written notice; the change applies from your next billing period. If payment fails we may suspend paid features until it is resolved.

5. Your data and responsibilities

You own the information you put into the Service ("Your Data"). You give us permission to host and process it only to provide the Service to you.

You are responsible for the accuracy and lawfulness of Your Data, including having a lawful basis to record any personal or health information about employees, contractors or members of the public, and for setting retention periods that suit your legal obligations.

Our handling of personal data is described in our Privacy Policy. Where we process personal data on your behalf, we do so as your processor and in line with the UK GDPR.

6. Acceptable use

You must not misuse the Service, including by attempting to access other organisations' data, probing or disrupting the platform, uploading malware or unlawful content, reselling the Service without our agreement, or using it in breach of any law.

7. Availability and support

We aim to keep the Service available and to back up your data, but we do not promise uninterrupted or error-free operation. We may carry out maintenance and will try to minimise disruption. You should keep your own copies of records you are legally required to retain, for example by exporting them to PDF.

8. Intellectual property

We and our licensors own the Service, including its software, design and branding. We grant you a non-exclusive, non-transferable right to use it during your subscription for your internal business purposes. Your Data stays yours.

9. Liability

Nothing in these terms excludes or limits liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, or for fraud.

Subject to that, we are not liable for indirect or consequential loss, loss of profit or goodwill, or for losses caused by your failure to meet your own legal or regulatory obligations, including any fine or enforcement action. Our total liability to you arising out of the Service in any 12-month period is limited to the fees you paid us in that period.

The Service is provided "as is" and, to the extent permitted by law, we give no warranties other than those set out in these terms.

10. Suspension and termination

You can stop using the Service and cancel your subscription at any time. We may suspend or end your access if you materially breach these terms, fail to pay, or if required by law, and will give notice where we reasonably can.

After termination you can request an export of Your Data for a reasonable period, after which we may delete it in line with our Privacy Policy.

11. Changes to these terms

We may update these terms. We will give notice of material changes, for example by email or in the Service. Continued use after a change takes effect means you accept the updated terms.

12. Governing law

These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction, except that if you are based in Scotland or Northern Ireland you may also bring proceedings in your local courts.
